1. Who we are and what these terms cover
These terms cover your use of clearhaccp.com, app.clearhaccp.com and everything we deliver through them: the free requirement checker, plan previews, paid plans, printable logs and labels, digital logs and inspector links ("the service"). By creating an account or buying a plan you agree to them. Questions: help@clearhaccp.com.
2. What ClearHACCP is, and is not
- ClearHACCP is software that prepares a HACCP plan, related letters and logs from your answers, using published FDA Food Code text.
- We are not a regulatory authority, a process authority, a laboratory or a law firm. Nothing on the site or in a plan is legal advice.
- We do not approve, certify or guarantee any plan, variance or food. Approval belongs to your local regulatory authority (FDA Food Code 8-201.13). A variance letter we prepare is a request for you to submit; we never say a variance is granted.
- Your state or county may use a different Food Code edition or add its own rules. Check with your health department before you start a process.
3. Your part
- You give us true and complete answers and confirm every menu item, temperature, time and recipe in your plan.
- You sign the plan. Signature lines are left blank; we never sign for you or insert a signature.
- Every plan states: "This plan must be reviewed and approved by your regulatory authority before you begin this process (FDA Food Code 8-201.13). Prepared from your answers; you are responsible for following it."
- You are responsible for how food is actually handled in your kitchen. We are not.
- You keep your account secure and only share inspector links with people you choose.
4. How the plan is built
Every critical limit, time and temperature comes from fixed, versioned rule packs that quote the FDA Food Code, with the section printed next to the number. AI may help phrase descriptive sentences inside a fixed structure; it never sets or changes a number. An answer outside Food Code limits is never smoothed over: the plan uses a Food Code limit, goes to a person for review as a variance, or is refused with the exact reason. We do not offer raw or undercooked options, or low-temperature variances, for kitchens that serve a highly susceptible population.
5. Prices and payment
Building a plan and reading its preview (the cover letter, the contents and the first sections; the rest stays locked until you buy) costs nothing. Prices are listed on the pricing page: the Process Plan is $249 once, the Kitchen Pack is $449 once, and each includes 12 months of digital logs, edits and inspector revisions. One-time purchases never renew. Only "Keep logs, monthly" ($15 a month) renews, and only if you choose it; you can cancel it in one click and it stops at the end of the paid month. Payments are processed by Whop, our checkout partner, under its own terms. We never see or store your card details.
6. Fix it or refund it
This promise is your remedy for problems with the documents we prepare.
- Revisions. For 12 months after purchase, send us your regulatory authority's written comments. We revise the plan within 2 business days at no charge, any number of rounds. The timer pauses while we wait on you.
- Refund. If, within 120 days of purchase, your regulatory authority declines the plan in writing after we made every change it asked for, we refund 100% of that purchase. This includes a jurisdiction that does not allow the process at all.
- Not covered. You did not submit the plan, you declined to make a requested change, or the requested change is to your kitchen (equipment, layout, a lab test) rather than to the document. In those cases we still revise the document free.
- Service levels. A plan routed to human review is checked within 1 business day (8 working hours, Monday to Friday, 9am to 5pm US Eastern). If we miss that, or the 2-business-day revision time, on work that was not waiting on you, the location gets 3 extra months of digital logs.
7. Your records
Your plans and logs are yours. You can read and export every log you ever entered, free, for as long as your account exists, even after your paid logging period ends. After 12 months, only new entries, edits and revisions need a logging option. See the privacy policy for how long we keep data and how to delete it.
8. Reviews and cashback
During launch, a founding reviewer can get 50% of their first purchase back (up to $125 per business, one per business, within 60 days of the purchase) for an honest video or written review. Any rating qualifies. The cashback never depends on what the review says, publishing needs your separate consent, and every published incentivized review carries a disclosure. We follow the FTC rule on consumer reviews and testimonials (16 CFR Part 465) and the FTC Endorsement Guides (16 CFR Part 255).
9. Referrals and affiliates
Referral credits are extra months of digital logs, not cash. Affiliate commissions are tracked and paid by Whop under its affiliate terms.
10. Acceptable use
Do not use the service to prepare documents for a kitchen you do not run or represent, to misrepresent a plan as approved or certified by us, to break the law, or to probe, overload or copy the service. We may suspend an account that does.
11. Limits of liability
The service is provided as is. To the extent the law allows: our total liability for any claim about the service is limited to the fees you paid us in the 12 months before the claim; we are not liable for indirect, incidental or consequential losses, including lost profits, discarded food, fines or closures; and we are not responsible for how food is actually prepared, handled, stored or served. Nothing in these terms limits rights that the law does not allow us to limit.
12. Changes
We may update these terms. If a change matters to you, we will email you before it takes effect. The date at the top shows the latest version.
