HACCP plan requirements by state

Which FDA Food Code edition each state lists for restaurants and retail, from the FDA's 2024 adoption report, with the agencies to ask. For 16 states we verified the edition against the 2022 Food Code, and for 5 we also checked local rules (where to submit, fees, forms). Everywhere else, check with your health department.

Whatever your state, the plan goes to the regulatory authority that issues your permit, and only it approves a plan or grants a variance. Check what your kitchen needs.

Frequently asked questions

Does every state use the FDA Food Code?
Most do, but not all the same edition, and a few agencies list none. The table above copies the FDA's 2024 adoption report row by row. Cities and counties can add their own rules on top.
Why does my state page say not yet verified?
Because we only print what we have checked against the official source, word for word: the edition a state adopts, and local rules such as where to submit and what it costs. Until then the page shows the FDA report, links the state agency, and tells you to check with your health department.

Every temperature, time and pH on this page is quoted from the FDA Food Code 2022 with its section number. Your state or county may run an older edition or add its own rules, and only your regulatory authority approves a HACCP plan or grants a variance.
