Which Food Code edition New Mexico uses

The FDA report on Food Code adoption (calendar year 2024 (period ending december 31, 2024)) lists New Mexico as using the 2017 Food Code.

New Mexico Environment Department adopts the FDA 2017 Food Code by reference (short form), so the Food Code text applies as printed. We compared that edition with the 2022 Food Code that ClearHACCP plans are built to, line by line for every limit we use.

What changes in a plan on the 2017 Food Code

  • Offer storage options one, two and frozen only; the combined option three of FC2022 is not in FC2017, where frozen is option three. 3-502.12(D)(2)(e)
  • Do not offer the warmer starting temperature for the four hour option; FC2017 has only the cold or hot holding start. 3-501.19(B)(2)

What needs a HACCP plan

Under the FDA Food Code 2022, a restaurant needs a HACCP plan before it starts any process that needs a variance, or before it vacuum packs without one:

Before engaging in an activity that requires a HACCP PLAN, a PERMIT applicant or PERMIT HOLDER shall submit to the REGULATORY AUTHORITY for approval a properly prepared HACCP PLAN as specified under § 8-201.14 and the relevant provisions of this Code if:

Does New Mexico require a HACCP plan for sous vide?
The FDA Food Code requires one for sous vide and cook-chill in a restaurant (3-502.12(D) in the 2022 edition). New Mexico adopts the 2017 Food Code by reference, so the Food Code text applies as printed. Ask your health department which forms its plan reviewers use. Check your process free.
